These Terms of Service (“Terms”) govern your access to and use of the Imaginativ app, website, and related services (“Service”).
By accessing or using our Service, you agree to these Terms in full. If you do not agree, please discontinue use of the Service.

2. Description of the Service

Imaginativ is an AI-based app for parents designed to bring magic and joy to their children. The app generates personalized video recordings for children based on input provided by parents. Users select a character, choose between text or audio input, and the AI generates a video where the selected character speaks the user’s input.

Imaginativ uses state-of-the-art AI models for voice and video generation.
The Service is intended for parents and adults only. Children may be recipients of the content but cannot directly use the Service.

A valid account is required to use the app. Users can register through Google Sign-In or other authentication providers offered by the Service.

3. Payments and Subscriptions

Imaginativ offers in-app purchases and may introduce subscription plans in the future.

Payment Processor: All payments are securely handled by Stripe.
Refunds: Users may request a refund within 7 days of purchase if not satisfied with the service.

All pricing and plan details are displayed within the app or on the website and may be updated periodically.

4. User Content

4.1 Ownership

Users retain ownership of all text, audio, and other content they upload or generate through the Service.

4.2 License to Use Content

By submitting content, you grant Imaginativ a non-exclusive, royalty-free, and revocable license to use, process, and store your content solely for:

Generating videos and providing the Service;
Improving AI model performance;
Demonstrating and researching product features, provided your content is not publicly shared without your consent.

You remain responsible for ensuring that any content you upload does not infringe on the rights of third parties.

5. Prohibited Uses

Users agree not to use the Service to:

Upload, share, or create content that is illegal, offensive, defamatory, or discriminatory;
Infringe on intellectual property or privacy rights;
Impersonate others or create misleading or deceptive material;
Misuse AI-generated content (e.g., deepfakes or altered videos for malicious or deceptive purposes);
Interfere with or disrupt the Service’s operation or security.

We reserve the right to suspend or terminate accounts that violate these Terms or applicable laws.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.
By using the Service, you acknowledge and agree to the practices described in the Privacy Policy.

7. Service Availability and Modifications

Imaginativ strives to provide a reliable and secure experience but does not guarantee uninterrupted or error-free operation.
We may modify, suspend, or discontinue any aspect of the Service at any time, temporarily or permanently, without prior notice.

We are not liable for any loss, damage, or inconvenience caused by such interruptions or modifications.

8. Limitation of Liability and Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind.
We make no guarantees regarding the accuracy, reliability, or suitability of AI-generated content.
To the maximum extent permitted by law, Imaginativ and its affiliates shall not be liable for:
- Indirect, incidental, or consequential damages;
- Data loss, revenue loss, or business interruption;
- Any errors, omissions, or issues arising from user-provided content or AI outputs.

Users are solely responsible for verifying and appropriately using any content generated through the Service.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of Brazil.
Any dispute arising from or relating to these Terms shall be resolved exclusively in the courts of São Paulo, SP, Brazil.

10. Changes to the Terms

We may update these Terms of Service from time to time.
When changes are made, we will notify users via the app or through other appropriate communication channels.
Continued use of the Service after such updates constitutes acceptance of the revised Terms.
